7 years in prison for illegal constructors
As for more than 15 years, in our country, the construction of an illegal object was tolerated, such thing is not going to happen anymore.Just after few days from the commencement of the implementation of the legalisation law, the government has drawn up a law, aiming to give an end to the illegal construction process in our country. So, all those that are going to build an illegal construction or object will be fined with 100 thousand lek and imprisoned with seven years. That because, in the draft-law the Council of Ministers has submitted for examination and approval in the Albanian Assembly, the illegal construction constitutes penal offence. The fine up to 100 thousand lek and seven years in prison is envisaged in article 5 of the draft-law “for some adjustments in the law “for the Control and Discipline of Construction Works”, approved yesterday during the meeting of the Council of Ministers. In this article of the draft-law, it is also envisaged that additional works in the construction volume constitutes penal offence and it is punished with 200 thousand lek and seven years in prison. “The carrying out of construction works without legal permit constitutes penal offence and it is punished with 100 thousand lek and up to seven years in prison. Meanwhile, the carrying out of construction works, resulting in additional works in the construction volume, breaching the requirements of the construction permit, constitutes penal offence and it is punished with 200 thousand lek and up to seven years in prison,” it is defined in the draft-law proposed by the government, amending an article of the existing law. Still in article 5 of the draft-law, it is envisaged that volumes performed through the carrying out of construction works, classified as penal offences, according to the above-mentioned amendment, when they are not demolished, the state confiscates them. The above mentioned amendments do not affect the constructions, subject of the law “for the legalisation, urbanisation and integration of illegal constructions”. Initially, the decision envisages that works supervisor has to control and is responsible for the implementation of construction works in compliance with the construction permit, design, technical conditions of the design and implementation, as well as with the object’s destination.
